At The Lopez Law Firm, PLLC, we understand you have questions about your immigration applications and petitions with U.S. Citizenship and Immigration Services (USCIS) and regarding your court cases with the Executive Office of Immigration Review (EOIR). Below you will find answers to some of our most frequently asked questions.

What Is My Case Status for My USCIS Application?

There is a tool on the USCIS website that allows you to track the status of your application, petition, or request, which you can find here. You will need a receipt number for this form. Your receipt number is a unique 13-character identifier that is given for each application or petition and can be found on the Form I-797 that is mailed or sent to you by immigration.

How Do I Check My Court Date?

You can check your court date using the Executive Office for Immigration Review (EOIR) website here. To access this information, you will need your A-number, which starts with the letter “A” and then has eight or nine digits. You can find this number on any EOIR, U.S. Department of Homeland Security (DHS) and/or Immigrations and Customs Enforcement (ICE) correspondence you have.

How Do I Change My Address with the Court?

To change your address with EOIR, you can complete an online form, which you can find here. However, you must also provide a copy of the document you complete to DHS. File the form within five business days of changing your address. Please send us any confirmation of any change of address you make with EOIR for our records, in the event the Immigration Judge requests proof that it was completed.

How Do I Change My Address With USCIS?

Changing your address with the U.S. Postal Service does not change your address with USCIS. You can change your address on your online account with USCIS or through filing form AR-11, which is a change of address form that will update your address on all your pending applications, petitions, or requests. If you use the online form, you do not need to mail this form in separately. You can get started here. Please send us confirmation of any change of address, in the event that USCIS makes an error and does not change your address. If your applications or petitions are filed the USCIS Vermont Service Center, please contact us, because the change of address must be emailed to USCIS through an email address given to attorneys.

When Will USCIS Process My Application and/or Petition?

Am I eligible to apply for the provisional waiver, Form I601A?

If you have an approved I-130 petition and the only reason why a U.S. consulate would deny your immigrant visa would be that you departed the United States after accumulating unlawful presence more than 180 days for the first time, you may be eligible for this benefit.  Also, you cannot have any other grounds of inadmissibility (no criminal offenses, drug-related problems, other immigration violations) to apply for this waiver.
